FLSA Case Settled on behalf of former City of Canton Police Sergeant for $107,000

On May 15, 2013, the United States District Court approved the settlement of a case brought by Former Police Sergeant Stacy Bailey against the City of Canton, Chief Robert Merchant, and City Manager Scott Wood. The suit, brought under the Fair Labor Standards Act of 1938, also known as the “Wages and Hours Bill,” alleged that Sergeant Bailey was unlawfully denied overtime pay and a pay raise for a Masters in Public Administration degree.

Following several depositions, the defendants entered into mediation and the case settled. As with most FLSA cases, the defendants paid Sergeant Bailey’s attorney fees and expenses. We were proud to represent Stacy Bailey and hope that the highly publicized settlement will encourage departments to examine their policies to ensure that LEOs are paid properly under the law.
